These Terms & Conditions constitute a binding agreement between you ("User," "Client," or "you") and Teratai ("we," "us," or "our"), a residence placement and lease coordination firm operating from Persiaran Perdana, 62100 Putrajaya, Malaysia. By engaging our services, communicating with our team, or submitting an enquiry through this website, you indicate that you have read, understood, and agree to be bound by these terms.
1. Definitions
For the purposes of this Agreement, the following terms carry the meanings set out below:
- Agreement — These Terms & Conditions, together with any service proposal, engagement letter, or written correspondence forming part of your service arrangement with us.
- Service — Any residence search, lease coordination, tenancy support, or concierge programme provided by Teratai as described on this website or in a formal service proposal.
- User / Client — Any individual or organisation who submits an enquiry, enters into a service arrangement, or accesses this website.
- We / Us / Our — Teratai, its principals, advisors, and representatives operating from Putrajaya, Malaysia.
- Content — All text, property information, images, documentation, and materials made available through this website or during service delivery.
- Platform — This website and any digital communications channels through which Teratai delivers information or engages with Clients.
2. Acceptance of Terms
Your use of this website or engagement of our services constitutes acceptance of these Terms & Conditions in full. If you do not agree with any part of these terms, you should not proceed with an enquiry or engage our services.
To enter into a service arrangement with Teratai, you must be at least 18 years of age and have the legal capacity to form a binding agreement under the laws of Malaysia. By proceeding, you confirm that you meet these requirements.
Where a Client is a corporate entity, the individual acting on behalf of that entity warrants that they have the authority to bind the organisation to these terms.
3. Service Description
Teratai provides residential placement and tenancy coordination services focused on the Putrajaya region of Malaysia, with particular attention to Persiaran Perdana, Precinct 9, Precinct 10, and Precinct 11. Our core service offerings are:
Putrajaya Residence Search (RM 2,470)
A focused search and candidate assessment service, with pre-visited property selections presented to the Client for consideration. This service covers residences within Teratai's established coverage area in Putrajaya.
Lease Coordination & Tenancy Support (RM 5,300)
A coordination service covering owner verification, lease preparation and review, deposit and utility handover, inventory documentation, and move-in walkthrough. A single point of contact is maintained between Client and property owner throughout the tenancy term.
Signature Waterside Residence Programme (RM 10,800)
A relationship-led programme for Clients seeking upper-tier residences in Putrajaya, including private viewings, building dossiers, airport reception, household staff introductions, and continuing concierge attention throughout the residency.
Service availability is subject to property inventory in Putrajaya at the time of engagement. We do not operate outside the coverage area described in our service documentation.
4. User Responsibilities
Clients engaging Teratai's services agree to conduct themselves in good faith and to provide accurate, complete information to facilitate the placement process. Specifically, Clients undertake to:
- Provide truthful information regarding their identity, residency requirements, budget parameters, and occupancy intentions.
- Respond to adviser communications within a reasonable time to avoid delays in the placement process.
- Not misrepresent their circumstances to property owners, or use Teratai's introductions for purposes other than those stated at engagement.
- Refrain from approaching property owners introduced through Teratai directly, outside of the formal lease arrangement, during and for a period of twelve months following service completion.
- Not use this website or our services for any purpose that is unlawful, fraudulent, or contrary to the laws of Malaysia.
- Not attempt to access, copy, or redistribute any proprietary property data, owner contact information, or internal documentation provided in the course of service delivery.
5. Intellectual Property
All content on this website — including written copy, design elements, property assessments, and advisory documentation — is the property of Teratai and is protected under applicable Malaysian intellectual property laws.
Clients are granted a personal, non-transferable licence to access this website and the service documentation provided to them for the sole purpose of evaluating and engaging Teratai's placement services. This licence does not extend to reproduction, commercial use, or redistribution of any content.
Any materials shared by Clients with Teratai in the course of service engagement — such as identification documents, correspondence, or photographs — remain the Client's property. By sharing such materials, Clients grant Teratai a limited licence to use them solely in connection with service delivery.
6. Payment Terms
All service fees are quoted and payable in Malaysian Ringgit (MYR / RM). Fees are as stated in the current service documentation at the time of engagement. Payment terms are as follows:
- Deposit: A service deposit may be required upon engagement confirmation. The deposit amount and structure will be set out in the formal engagement letter.
- Balance: The remaining service fee is typically payable upon successful placement or at the stage specified in the engagement agreement.
- Payment Methods: Accepted payment methods will be confirmed in writing at the time of engagement.
- Refunds: Service fees are generally non-refundable once the active search or coordination phase has commenced. Where exceptional circumstances apply, refund requests will be considered at Teratai's reasonable discretion.
- Price Changes: Teratai reserves the right to revise service fees. Any fee change will be communicated clearly and will not apply to engagements already confirmed in writing.
7. Service-Specific Terms
In addition to the general terms set out in this Agreement, the following provisions apply to the delivery of Teratai's services:
Scope and Delivery
The scope of each service is as described in our service documentation and, where applicable, in the formal engagement letter. Scope changes requested after engagement confirmation may be subject to additional fees.
Timelines
Residence placement timelines depend on property availability in Putrajaya at the time of search, and on the Client's responsiveness to candidate presentations. We will communicate realistic timelines at the outset and keep Clients informed of progress.
Confidentiality
Both parties agree to handle each other's confidential information with discretion. Client information will not be shared with third parties except as necessary to facilitate property introductions, legal documentation, or regulatory compliance.
Third-Party Obligations
Teratai acts as an intermediary and advisor. Lease agreements are entered into directly between the Client and the property owner. Teratai is not a party to the lease and holds no responsibility for the conduct of property owners following placement.
8. Disclaimers
This website and our service documentation are provided for informational purposes. While we aim for accuracy in all property descriptions and assessments, Teratai does not warrant that all information is entirely free from error at all times.
Our advisory and placement services are provided with professional care and diligence. However, we do not make any representation that a particular residence will be available, that a tenancy will be successfully secured, or that the Client's residency experience will meet any specific expectation beyond what is within our reasonable control.
This website does not constitute legal or financial advice. Clients with specific legal questions regarding property law in Malaysia are encouraged to seek independent legal counsel.
9. Limitation of Liability
To the extent permitted by Malaysian law, Teratai's total liability to a Client under or in connection with a service engagement shall not exceed the total service fees paid by that Client in connection with the relevant service.
Teratai shall not be liable for any indirect, consequential, or incidental loss arising from the use of this website or from the delivery of our services, including but not limited to loss of revenue, loss of opportunity, or costs incurred as a result of delays in placement.
Nothing in these Terms & Conditions shall limit liability for death, personal injury caused by negligence, or fraud — as such limitations are prohibited under applicable Malaysian law.
10. Indemnification
The Client agrees to indemnify and hold harmless Teratai, its principals, and representatives against any claims, losses, or costs arising directly from the Client's breach of these Terms & Conditions, provision of inaccurate information, or conduct that causes harm to a property owner or third party introduced through our services.
This indemnification obligation shall survive the termination of any service engagement.
11. Termination
Either party may withdraw from a service engagement by providing written notice. Teratai will confirm the process for withdrawal, including any applicable fee considerations, in the formal engagement letter.
Teratai reserves the right to discontinue service to a Client whose conduct is found to be dishonest, abusive towards our team or property owners, or in material breach of these Terms & Conditions.
Upon termination, provisions relating to intellectual property, confidentiality, limitation of liability, indemnification, and dispute resolution shall continue in effect.
12. Dispute Resolution
These Terms & Conditions are governed by the laws of Malaysia. Any dispute arising out of or in connection with these terms shall be subject to the jurisdiction of the courts of Malaysia, with Kuala Lumpur as the agreed seat for proceedings.
Before initiating formal proceedings, both parties agree to make a genuine effort to resolve any dispute through direct and good-faith communication. Clients are encouraged to raise concerns with Teratai's principal advisors in the first instance.
Where informal resolution is not achieved within thirty days of a written notice of dispute, either party may proceed to mediation under the auspices of the Malaysian Mediation Centre, or pursue the matter through the courts as appropriate.
13. General Provisions
- Entire Agreement: These Terms & Conditions, together with any formal engagement letter, constitute the entire agreement between the Client and Teratai in respect of the services.
- Severability: If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full effect.
- Waiver: Failure by Teratai to enforce any provision of these terms on a particular occasion shall not constitute a waiver of the right to enforce that provision in future.
- Assignment: Clients may not assign their rights or obligations under this Agreement without Teratai's prior written consent.

14. Changes to Terms
Teratai may update these Terms & Conditions from time to time to reflect changes in our services, applicable law, or operational practice. When changes are made, the updated version will be published on this page with a revised "Last Updated" date.
Continued use of this website or ongoing engagement with our services after a change has been published constitutes acceptance of the revised terms. Clients with active service engagements will be notified of material changes directly.
